Terms and Conditions of the Service (TOS) of the Tourist Accommodation Establishment Venice Central SML di Paduano Nello SAS who manages “Locanda SS Giovanni e Paolo” in Castello 6401 in Venice (Italy) – hereinafter referred to as ‘Tourist Accommodation Establishment’ or ‘TAE’.
- Scope and validity
These Terms and Conditions apply to all guest accommodation contracts that are concluded between the Tourist Accommodation Establishment with a third party (guest) also for all future bookings/contracts. These Terms and Conditions can be requested in the Tourist Accommodation Establishments. For this fact alone, the Terms and Conditions are to be made known sufficiently to the customers, the rental parties and third parties, in accordance with legal regulations.
By adopting a reservation made by the guest accommodation, a binding contract with the Tourist Accommodation Establishment is agreed once the reservation made by a guest is accepted. This agreement, in the form of a reservation of booked rooms or beds, is binding for both parties. The reservation for ordered rooms or beds is valid until 18:00/6pm on the day of arrival. There is no right for the guest to use or request a particular room or bed. The accommodation shall provide guest a room which is in accordance with the room type booked (for example, double room or triple room with or without private bathroom, …). If the booked accommodation (room, bed) shouldn’t be available for whatever reason (overbooking, works, etc.) the Tourist Accommodation Establishment reserves the right, to host the guest in other own or third party Tourist Accommodation Establishment of a similar quality standard and at the same conditions (prices). By booking an accommodation (reservation) with Tourist Accommodation Establishment the guests accepts this condition explicitly. If the guest does not accept one of the alternative accommodation establishments, guest will be charged nevertheless the full price of the booking.
If the Tourist Accommodation Establishment, however, should fail to offer at least one alternative accommodation, the guest will be refunded of the full up-front payment. The Tourist Accommodation Establishment reserves the right to rent out the reserved rooms or beds once again after the expiry of the reservation.
The guest will receive a binding booking/reservation number or confirmation by the Tourist Accommodation Establishment or the authorized online placement and booking company.
The Tourist Accommodation Establishment reserves the right to correct prices which are obviously erroneous, i. e. below the minimum price of 30€ per person per night. In that case each guest has to pay the minimum price of 30€ per night.
It is prohibited for guests or third parties to sell-on, or rent-on, beds or rooms booked by either the guest or third party. In particular, it is prohibited to rent-on rooms and/or room allocations or beds to third parties at higher prices than the actual bed/room is listed at on the own website of the Tourist Accommodation Establishment. The transfer or sale of the claim against the Tourist Accommodation Establishment is not allowed. In these cases, the Tourist Accommodation Establishment has the right to cancel the booking, especially if the guest has made a booking/sale to a third party using false information about the nature of the booking or payment. Moreover, the Tourist Accommodation Establishment is entitled to charge the guest the full amount of the booking, any additional costs incurred for such cases and an additional administration fee of 50€.
- Guaranteed reservations, check-in times and cancellation deadlines
A reservation is guaranteed if the guest has been confirmed with the Tourist Accommodation Establishment, using a credit card number, or making an upfront-payment or making a binding reservation.
Due to the fact that guest by booking directly with the Tourist Accommodation Establishment will get the best price on the market, the booking made is considered a non-refundable booking, i.e. the booking can’t be cancelled or modified and the total price of the reservation will be charged in any case. Refunds are not possible for whatever reason, also in case of no-show.
The Tourist Accommodation Establishment reserves the right to charge or to pre-authorize the whole amount due to in each moment after booking. Guest has to make sure that the whole amount can be charged or pre-authorized to his credit card after booking. If it shouldn’t be possible to pre-authorize or charge the amount of the booking to the credit card than Tourist Accommodation Establishment reserves the right to cancel the booking and to resell the room.
At checkin the booker must be present, i.e. the person who has booked through the website of Tourist Accommodation Establishment and must be in possess of a valid document (ID or passport) and the booking confirmation showing his name and last name. The booking can’t be sold or given to other persons. The guest booked can show up with other persons for which he has booked. The total number of guests can’t exceed the number of guests determined for the booked room. The other guests booked can access the Tourist Accommodation Establishment only with the guest which is booked with the Tourist Accommodation Establishment.
Due to the fact that Tourist Accommodation Establishment is a small accommodation, binding check-in times have to be agreed with the management of the Tourist Accommodation Establishment at least 48 hours prior to arrival day and have to be within the official check-in timeframe. Official check-in time is from 2 hours (14 pm) to 20 hours (8 pm). Guests who are not able to check-in during the binding check-in time which they have communicated to the Tourist Accommodation Establishment are obliged to inform the Tourist Accommodation Establishment immediately about it, at least 48 hours prior to arrival day. Tourist Accommodation Establishment can’t guarantee that it can accept a modified check-in time which has been communicated to Tourist Accommodation Establishment with a notice of less than 48 hours prior to arrival. In that case guest accepts that his booking will be treated as no-show and guest does not have the right to occupy the room booked while the whole amount of the booking will be charged to guest. If guest wishes to check-in to a different time than the standard times, this has to be agreed upon with the management at least 48 hours prior 00:00 o’clock of the arrival day. Failure to show-up within the agreed or standard check-in time on arrival day will be treated as no-show and the full amount of the booking will be charged. In that case the amount charged by the Tourist Accommodation Establishment has to be considered as a „penalty“ for not having respected the mutual contractual agreements (See also Italian Law: Art 10, DPR 633/1972).
Check-ins after the official check-in time are subject to a surcharge.
If staff of the accommodation has to meet guests outside the accommodation and bring them to the accommodation, than a specific surcharge will be applied.
Failure to show-up on the day of booking (no-show) and also cancellations will result in the full amount of the booking being charged to the guest. In case of no-show or late cancellation the room booked will be offered immediately online and the guest who failed to show up or has cancelled the booking does not have any right to occupy the room. In the case of a no-show, the Tourist Accommodation Establishment reserves the right to charge an extra service fee if necessary.
A guest who will cancel his reservation or will not show up on arrival day authorizes the management of the Tourist Accommodation Establishment to withdraw the full amount of his booking (reservation) from his credit card. The amount due will be withdrawn by the accommodation, within 2 years after the arrival date.
All bookings must be re-confirmed by guest at least 48 hours before arrival day by email, telling the exact arrival time. If guest doesn’t reconfirm the booking the Tourist Accommodation Establishment reserves the rigth to consider the booking as cancelled and to resell the room.
- Advance payment of the room rate
The price of the entire booking must be paid by the guest on the arrival in the Tourist Accommodation Establishment in advance and in cash. For the use of credit cards for payments, the figure will be rounded up to the nearest Euro, including a 4% service charge of the due balance. For payments which are received after the arrival day, the price due will be increased of 20€ for each day of delay after the arrival day.
- Taxes/ fees/ charges
The applicable prices are gross prices and include all applicable taxes, fees and charges. In the event of any changes in tax, fees and levy rates, as well as the effective collection of new, previously unknown taxes, fees and charges to the guests’/parties’ taxes, the Tourist Accommodation Establishment reserves the right to adjust prices accordingly.
The statutory local tourist tax (city or tourist tax) of the city of Venice is not included in the room prices and has to be paid fully and separately by the guest. - Payment methods/ Services payable at a later date
Valid means of payment include cash (Euros), debit cards, Euro Card, credit cards like Visa and Amex (in Euros) as longs as the corresponding POS equipment is available. Paying for services at a later date is not possible.
- Hours of use for reserved rooms
Reserved rooms or beds are available to guests from 14.00 (2 pm) on the day of arrival and until 10.00 (10am) on the day of departure.
- Liability risks of guests’ possessions
Items or materials that are left behind in generally accessible areas of the Tourist Accommodation Establishment, in the technical areas and in the lounge of the Tourist Accommodation Establishment shall no longer be deemed as the possessions of the guests. The Tourist Accommodation Establishment is under no circumstances the safe keeper or trustee of the guests’ items brought into to Tourist Accommodation Establishment, and therefore not liable for whatever may happen to the guests’ items or valuables. The Tourist Accommodation Establishment stress that it offers no storage option in a safe or similar security container. Items are therefore brought into the Tourist Accommodation Establishment at one’s own risk. The Tourist Accommodation Establishment is also not the safe keeper or trustee of luggage, suitcases, bags or other items that belong to the guests, and after checking out, leaving such items in the available space provided in the luggage room is at the owner’s risk. The guest has to inform the Tourist Accommodation Establishment at his arrival (check-in) about all items which have a value of more than 250€ so that the Tourist Accommodation Establishment can agree with the guest upon reasonable storage places and strategies. If the guest has failed to inform the Tourist Accommodation Establishment at his arrival upon items which have a value of more than 25€, than the Tourist Accommodation Establishment will not be liable for whatever may happen to the guests’ items or valuables.
- Food and drink purchased outside the Tourist Accommodation Establishment
In public areas of the Tourist Accommodation Establishment, the consumption of food and drink purchased outside the Tourist Accommodation Establishment is prohibited. The Breakfast Buffet can only be consumed in the designated premises of the public areas (hall, lounge, and kitchen) of the Tourist Accommodation Establishment. Taking away food or drinks that are offered in the Breakfast Buffet is not possible. Preparing food in the rented bedrooms is also prohibited.
- No smoking in the Tourist Accommodation Establishments
The Tourist Accommodation Establishment facilities in Italy are all non-smoking due to legal obligations. It is therefore absolutely prohibited to smoke in both the public areas and in the guest rooms and bedrooms. In the event of an infringement of our non-smoking policy, the Tourist Accommodation Establishment has the right to ask the guest to pay compensation of 500€ for any special cleaning costs, or possible loss of revenue from a loss of possible rental of the room or the bedroom as a result of the infringement. This amount of compensation may be increased or decreased if the Tourist Accommodation Establishment or guest provides proof of the costs incurred as a result of the guest not following the non-smoking policy.
- Group Bookings
Bookings of 1 room or more can only be guaranteed with the applicable full reservation payment.
- No parties policy
The number of guests gathered overnight (i.e. after 22 hours/10pm until 10 hours/10am) must not exceed the number of persons booked. Any persons exceeding this number will be considered as trespassers.
Trespassers are charged to the credit card of the booker with 250€ per night.
Noise must be kept to a minimum level at all times.
If any noise complaints are received from the neighbouring residents guest will be asked to leave the premises immediately. The Tourist Accommodation Establishment tariff will not be refunded, security deposit may not be refunded.
The registered guest will be held financially responsible for any loss or damage caused during his/her stay.
- Pre-Authorization on arrival:
Credit Card BELONGING TO THE RESERVATION HOLDER MUST be presented for authorization on arrival. Credit Card holder must be the registered guest. A pre-authorization of €200 minimum plus outstanding accommodation charges, will be processed on the credit card at check-in. Pre-authorizations amounts are set aside by the credit card company for up to 45 days and will temporarily affect your available funds balance or spending limit.
The guest agrees that the credit card provided can be charged by the Tourist Accommodation Establishment or another person or entity authorized by Tourist Accommodation Establishment.
The guest agrees that the amounts due to can be charged in local currency or another currencies to the credit card provided by the sole discretion of Tourist Accommodation Establishment.
Refund of the security bond is subject to inspection of the room upon departure or upon the return of all keys. The guest will automatically forfeit the bond if:
Any item is removed from the premises.
There is any damage caused to Tourist Accommodation Establishment, by the guest or anyone invited to the property by the guest. This includes all items and structures inside the accommodation all external and communal areas on Accommodation.
The guest breaches the above.
The guest agrees that he will pay Tourist Accommodation Establishment the room rate for each day of his stay and any additional charges up until the time he advises that he has departed from the occupied rooms.
The guest agrees that any charge for services, not billed at the time of the departure, may be added to his account for settlement as arranged or may be charged to the same credit card used to pay the account at the time of departure or to the credit card used to guarantee payment of his account.
The guest agrees that checkout time is 10 hours / 10.00 am on the date shown for his departure unless the Tourist Accommodation Establishment agrees to another time.
The guest agrees departure after that time may incur additional room charges.
The guest agrees that the Tourist Accommodation Establishment may apply a charge if the check-in time requires the Tourist Accommodation Establishment to keep the room empty on the previous day.
The guest agrees to pay interim accounts when presented even though he may not have departed from the rooms.
The guest agrees to advise the Tourist Accommodation Establishment of any change in the number of persons using the room and agree to pay any additional charges for additional persons not included in the number stated at the time of registration.
The guest agrees that he is and remains personally liable to pay the total amount due on departure unless prior settlement arrangements have been accepted by the Tourist Accommodation Establishment. If the settlement arrangements have not been met within 30 days of departure guest agrees to pay the total amount due on receipt of the invoice or receipt.
The guest agrees to pay the Tourist Accommodation Establishment for any loss or damage to the room or equipment in the room during period of use. Any loss or damage will be quantified by the Tourist Accommodation Establishment and invoiced to guest. The Tourist Accommodation Establishment will withdraw the amount due from the credit card/debit card.
The guest agrees that the only service that the Tourist Accommodation Establishment has to guarantee is a bed-room or a bed based on his individual booking.
The guest agrees that the Tourist Accommodation Establishment is allowed to offer guest an alternative accommodation with respects the same standards.
The guest agrees that the malfunction or the unavailability of additional services like air condition, breakfast, Internet, hot or cold water etc. do not automatically give guest the right to pretend a discount or refund. Guest has to inform Tourist Accommodation Establishment immediately about malfunctions or unavailabilities and give Tourist Accommodation Establishment 48 hours to fix the problem.
The guest agrees to return the key and/or security card for the room at the time of his departure and agree to pay a charge for the replacement of keys you lose or fail to return same. The amount for the replacement of the keys is determined in 50€. If guest leaves without giving back the room keys, guest allows Tourist Accommodation Establishment to withdraw from his credit card 50€ for the replacement of the keys.
The guest agrees that the Tourist Accommodation Establishment can’t guarantee the quality of the WIFI-connection and its availability.
The guest agrees that the Tourist Accommodation Establishment may charge to the guest credit card the amount of up to 1 to 3 day rates of up to 150€ (total 450€) each if guest leaves the room dirty after his check-out and therefore chambermaid of Tourist Accommodation Establishment needs more time than normally to clean the room of guests. The same surcharge applies if guest leaves particular garbage/trash in the room like broken bags, trolleys, suitcases, hairdryer, electronic devices, etc.
The guest agrees that it is strictly forbidden to cook inside the rooms. If guests cook inside the room, Tourist Accommodation Establishment may charge to guest up to 500€ flat per day.
The guests agree that he responds also for actions, damages, breach of clauses and abuses from his partner(s) or other guests which are booked with him.
The guest agrees that if he requests an upgrade from a room with a shared bathroom to a room ensuite (i.e. a room with a private bathroom), Tourist Accommodation Establishment is allowed to charge to guest credit card an additional fee of 120-250€ per day.
The guest agrees any monies or other valuables, goods or vehicles that belong to him, brought in or on to the rooms or grounds remain his responsibility and Tourist Accommodation Establishment is not responsible for their safekeeping.
The guest agrees that he will not make any claim against Tourist Accommodation Establishment for any damage or loss to his goods or valuables, regardless of how or where the loss or damage occurred.
The guest agrees that if accommodation has to send him forgotten goods (cell phones, cameras, wallets, personal belongings, etc…) than accommodation is authorized to charge the costs of the postal services and other costs incurred to the credit card of guest.
The guest agrees that regardless of his length of stay there is no tenancy or other rights created under any Landlord or Tenant laws and there are no such laws that apply to his stay. Tourist Accommodation Establishment grant guest a license to stay in its rooms and guest agrees that Tourist Accommodation Establishment may terminate the license at any time without giving guest a reason.
The guest agrees that it is not necessary that a third party confirms damages, status of rooms, the breach of one of the other clauses. It is sufficient the testimony of one of the workers or of a manager of the Tourist Accommodation Establishment to attest this.
The guest accepts that for claims against him the attestation of the chambermaid, the receptionist or the owner is sufficient, i.e. the claim has to be attested by only one member of the staff of the Tourist Accommodation Establishment or the owner himself. Furthermore guest accepts that also photos made by the management of the Tourist Accommodation Establishment are sufficient proofs for the breach of the rules of the Tourist Accommodation Establishment by guest.
The guest accepts that any additional charge, cost, deposit, penalty ecc. may be charged to his credit card or antoher credit card provided during the booking process or after.
The guest confirms that if he has provided a credit card during the booking process which is not his personal one, that he has been explicitly authorized by the owner of the credit card for the usage of the credit card provided for the transaction
Jurisdiction for all disputes between the parties arising out of the contractual relationship, as far as the contractor of the Tourist Accommodation Establishment, legal entity under public law or public law special fund is concerned, is in Venice (Italy).
